Terms and Conditions
These terms govern access to SudoHire, a technology platform maintained by SudoCodeLab, by talent, employers, clients, team members, and administrators. They do not remove rights or duties that applicable law makes mandatory.
Effective: 14 August 2026Platform role
SudoHire provides technology for profiles, opportunities, applications, collaboration, and hiring workflows. Unless SudoCodeLab signs a separate written agreement expressly saying otherwise, SudoCodeLab is not an employer, co-employer, recruiter, staffing agency, labour contractor, partner, agent, payroll provider, or party to an engagement between users. It does not direct work, set working hours or compensation, provide benefits, withhold taxes, or guarantee a user's identity, authority, skills, vacancy, candidate, engagement, or outcome.
Eligibility and accounts
You must have legal capacity to accept these terms, provide accurate and current information, protect account access, and use a company-authorized email where employer verification is required. You are responsible for activity through your account and for ensuring each team member receives only the access needed for their role.
Freelance, moonlighting, and secondary work
SudoHire permits users to describe availability for freelance, contract, part-time, moonlighting, or secondary work where lawful. A platform label describes a preference only; it does not create a legal right, approve outside work, or determine employment status. The Flexible Work & Moonlighting Policy forms part of these terms.
Talent responsibilities
Before accepting or performing secondary work, talent must review applicable employment agreements, workplace policies, confidentiality and intellectual-property duties, conflict rules, sector restrictions, work authorization, and legal working-time or rest requirements. Talent must obtain any consent or give any notice that is lawfully required, and must not perform outside work using a primary employer's paid time, systems, funds, premises, confidential information, trade secrets, or intellectual property without authorization.
Employer and client responsibilities
Employers and clients must independently verify a person's authority and availability to undertake work, avoid knowingly inducing a contractual or legal breach, and use accurate written terms covering scope, control, hours, fees or wages, expenses, intellectual property, confidentiality, privacy, safety, termination, and dispute handling. They are responsible for lawful recruitment, onboarding, supervision, payment, records, notices, and required registrations.
Classification and mandatory protections
Calling a person a freelancer, consultant, contractor, gig worker, moonlighter, or employee does not determine their legal status. The real working arrangement and applicable law control. Users must not use SudoHire or a contract label to evade wage, overtime, leave, social-security, provident-fund, insurance, workplace-safety, anti-harassment, accessibility, non-discrimination, collective, termination, or other mandatory protections.
Working time, wellbeing, and safety
Each party must comply with applicable limits on working time, overtime, weekly rest, leave, workplace conditions, and occupational health and safety. Employers and clients should assess combined workloads where known. Talent must not accept work that would make performance unsafe, unlawful, or materially impaired.
Payments, taxes, and benefits
Users are responsible for agreeing and making payments outside the platform unless a SudoHire feature expressly states otherwise. Each party must determine and meet its own invoicing, recordkeeping, income-tax, withholding or TDS, GST, payroll, benefit, social-security, licensing, and reporting duties. SudoHire does not provide tax, employment, or legal advice.
Confidentiality and intellectual property
Do not upload, disclose, solicit, copy, or use another person's or organization's confidential information, personal data, source code, customer information, trade secrets, or intellectual property without authority. Users must agree ownership and permitted use of work product directly and must respect pre-existing and third-party rights.
Hiring content and decisions
Employers are responsible for every job description, screening criterion, message, candidate share, and hiring decision. Content and decisions must be accurate, lawful, job-related, accessible where required, and non-discriminatory. Candidate information may be shared only for a legitimate hiring purpose with people who are authorized and bound to protect it.
AI-assisted features
AI output is a draft and may be inaccurate, incomplete, biased, or unsuitable. A qualified human must review it before publication or use. SudoHire does not make employment decisions, and AI scores, matches, or summaries must not be the sole basis for ranking, rejection, or hiring.
Acceptable use
Do not post deceptive or unlawful roles, impersonate another person, collect data without a legitimate purpose, discriminate unlawfully, misclassify workers, evade legal obligations, bypass access controls, scrape or resell data, introduce malicious code, spam, commit fraud, retaliate unlawfully, or use the service to breach another agreement or legal duty.
Service, plans, and availability
Trials, plans, features, limits, and prices may change as disclosed in the product or an order. The service may be interrupted for maintenance, security, or events outside reasonable control. No job, candidate, application, interview, engagement, earnings, or hiring outcome is promised.
Suspension, reports, and removal
SudoHire may investigate reports and restrict, suspend, or remove accounts or content where reasonably necessary for security, legal compliance, user safety, or enforcement of these terms. Users should report suspected fraud, unlawful work, confidentiality breaches, misclassification, harassment, or unsafe conduct through the published support channel.
Liability and responsibility
Each user remains responsible for its content, decisions, contracts, legal classification, payments, taxes, conduct, and use of candidate data. To the extent permitted by applicable law, a user is responsible for third-party claims directly caused by that user's unlawful conduct, infringement, misuse of data, or breach of these terms. Nothing in these terms excludes liability, remedies, consumer rights, worker protections, privacy rights, or access to a mandatory forum where exclusion is prohibited by law.
Local law and professional advice
Applicable central, state, local, sector-specific, and cross-border rules prevail over conflicting contract wording. These terms are general platform rules, not legal, tax, labour, immigration, or accounting advice. Users should obtain independent professional advice for their circumstances. Governing law, jurisdiction, and any negotiated dispute process in a signed order or service agreement apply subject to mandatory law.
Changes and contact
SudoHire may update these terms to reflect product or legal changes and will publish the effective date. Material changes will be notified where required. Questions, legal notices, or disputes may be sent to the support or legal contact published by SudoHire or stated in the applicable order form.
